New Rules for Birth and Death Registration Take Effect October 1

NEW DELHI – New provisions for registering births and deaths across the country will come into effect starting October 1, 2026.

Passed during the Monsoon Session of Parliament as the Registration of Births and Deaths (Amendment) Act, 2026, the updated law received Presidential assent and was formally notified by the Ministry of Home Affairs on September 16, 2026.

The main objective of the new law is to make vital statistics records more accurate, transparent, and timely. Under the revised framework, strict authorization tiers have been introduced to oversee late filings:

1 to 2 Years Delay: Registrations delayed between one and two years will now require an official order from the District Magistrate (DM), Sub-Divisional Magistrate (SDM), or an Executive Magistrate authorized by the DM. These applications will also require detailed verification and the payment of a prescribed fee.

More Than 2 Years Delay: For any registration delayed by more than two years, approval must be granted directly by an order from a First Class Judicial Magistrate.

The amendments aim to enforce greater scrutiny and administrative oversight for records registered after significant delays, curbing fraud and ensuring database integrity.
