The Motor Accident Claims Tribunal (MACT) has awarded ₹64.75 lakh to the kin of a Pune-based businessman who died following a tragic road accident, reinforcing the principle of “just compensation.”

The order, delivered by MACT member RV Mohite, comes as a major relief to the family of 42-year-old Yuvraj Bhagawan Jagtap, who had been struggling with a severe financial crunch since the breadwinner’s demise.

The Fatal Collision in Chikhali

The incident dates back to November 24, 2022. Jagtap, who operated a thriving automobile servicing business in Pune, was crossing the road near Chikhali when a speeding motorcycle crashed into him. The impact resulted in severe head trauma. Despite nearly three weeks of medical intervention, Jagtap succumbed to his injuries on December 13, 2022.

The claimants, including his wife, two sons, and elderly parents, moved the tribunal seeking justice. Interestingly, while the family estimated the total damages at over ₹2.19 crore, they had restricted their formal prayer in the petition to a mere ₹1 lakh, citing their inability to pay the court fees required for a higher claim at the time.

Tribunal Rejects Contributory Negligence Pleas

During the proceedings, the Thane-based insurance firm contested the claim, alleging that the deceased was negligent while crossing the road. They further argued that the motorcyclist lacked a valid driving licence.

However, the MACT dismissed these contentions after reviewing police reports and eyewitness testimony. The tribunal noted:

“The victim was walking on the road with proper care and caution. The motorcycle came at high and excessive speed without keeping a watch on the traffic conditions. This shows rash and negligent driving.”

The court confirmed the rider held a valid licence and found zero evidence of “contributory negligence” on Jagtap’s part.

Defining “Just Compensation”

In a move that highlights the tribunal’s mandate to ensure equity, the court ignored the family’s restricted prayer of ₹1 lakh. Recognizing the loss of a young businessman, the MACT assessed Jagtap’s notional income at ₹35,000 per month.

The final award of ₹64.75 lakh accounts for:

  • Loss of future income and prospects.
  • Medical expenses incurred during treatment.
  • Loss of consortium and funeral expenses.

Securing the Family’s Future

To prevent the mismanagement of funds, the tribunal directed that a substantial portion of the compensation be placed in fixed deposits in the names of the widow and the two children. The owner of the motorcycle and the insurance company have been ordered to pay the amount “jointly and severally,” along with 9% annual interest effective from the date of the petition.

This ruling serves as a stern reminder to motorists regarding the legal consequences of speeding and offers a blueprint for families seeking “just compensation” under the Motor Vehicles Act, even when financial constraints limit their initial legal filings.
